Overview of How SARA Impacts Out of State Distance Education Students with Respect to Consumer Protection Complaints 

Provisions of the SARA Policy Manual, including those for consumer protection and the resolution of complaints, apply to interstate distance education offered by participating SARA institutions to students in other SARA states. Only those complaints resulting from distance education courses, activities and operations provided by SARA-participating institutions to students in other SARA states come under the coverage of SARA. Complaints about a SARA institution’s in-state operations are to be resolved under the state’s normal provisions, not those of SARA (SARA Policy Manual).

Complaints against SARA-participating institutions must first follow the institution's grievance resolution procedures. However, allegations of criminal offenses or violations of state law may be reported directly to the appropriate state agencies (SARA Policy Manual).

Students dissatisfied with an institution's resolution of a complaint may appeal to the SARA Portal Entity in the institution's home state. This excludes complaints about grades or student conduct violations. Appeals must be filed within two years of the incident (SARA Policy Manual).

Student who wish to appeal complaints after the on-campus process is complete, should bring their complaint to the CUNY Central Office of the General Counsel:

Lehman College Professional Licensure Disclosures

New York State prides itself in the high quality of its licensed and certified professionals.  For the protection of its citizens, each license and certificate has requirements that individuals must meet in order to be licensed or certified in New York State. A number of programs at Lehman College lead to a professional license or certification that is required for employment. Such programs are carefully designed to meet and exceed these State requirements. Professional licensure/certification requirements vary from state to state, which may affect a student’s ability to apply for a professional license/certification upon the completion of the program.

Lehman College is a member of the National Council for State Authorization Reciprocity Agreement (NC-SARA), which allows us to provide distance learning programs and coursework to residents of states other than New York. NC-SARA membership, however, does not grant reciprocity or exempt us from state professional licensing requirements. As a result, licensing requirements in New York may not be recognized as sufficient to obtain a license in any other state.

The U.S. Department of Education regulations §668.14 and §668.43, require an institution to disclose whether the program will fulfill educational requirements for licensure or certification for each state. The administrative departments that offer the programs have made the following determination regarding their curriculum.

This is a role CUNY plays in protecting the public.  Other states frequently have their own requirements, so if your goal is to practice in another state, this disclosure will help you check to see what that state requires.

Per U.S. Federal Regulations, §668.14 and §668.43, and in compliance with the SARA Policy Manual, CUNY Lehman College provides the following disclosure related to the educational requirements for professional licensure and certification. 

This Disclosure is strictly limited to the CUNY Lehman College determination of whether this academic program, that if successfully completed, would be sufficient to meet the educational licensure or certification requirements in a State for Teaching.  CUNY Lehman College cannot provide verification of an individual’s ability to meet licensure or certification requirements unrelated to its educational programming.  Such individual determinations are made by state licensing boards and are fact-specific determinations.

This disclosure does not provide any guarantee that any particular state licensure or certification entity will approve or deny your application. Furthermore, this disclosure does not account for changes in state law or regulation that may affect your application for licensure and occur after this disclosure has been made. Enrolled students and prospective students are strongly encouraged to contact their state’s licensure entity using the links provided to review all licensure and certification requirements imposed by their state(s) of choice.
